These Terms of Service (“Terms,” “Agreement”) govern your participation in the Affiliate Program (“Program”) offered by Stanley Evans / Book Zero Publishing (“Company,” “we,” “us,” “our”). By applying to or participating in the Program, you (“Affiliate,” “you,” “your”) agree to be bound by these Terms. If you do not agree, do not participate in the Program.
1. Eligibility
To join the Program, you must:
– Be at least 18 years old.
– Have a valid PayPal account capable of receiving payments.
– Submit accurate information during registration.
– Agree not to misrepresent yourself, your identity, or your relationship to the Company.
We reserve the right to approve or reject any application for any lawful reason.
2. Affiliate Relationship
Affiliate is an independent contractor, not an employee, partner, representative, or agent of the Company.
You have no authority to act on behalf of the Company, make promises, or create obligations.
Participation does not grant you any ownership in our intellectual property or business.
3. Commissions
3.1 Commission Rate
Affiliates earn 30% commission on qualifying sales unless otherwise stated in writing.
3.2 Qualifying Sales
A sale qualifies when:
– The customer arrives through your unique affiliate link.
– The customer completes the purchase without refund.
– Payment is successfully processed by PayPal.
– Fraud is not suspected.
3.3 Payout Schedule
Payments are made via PayPal:
– After a refund/chargeback waiting period of 14 days.
– When the affiliate reaches the minimum payout threshold of $20 USD, unless otherwise agreed.
– To the PayPal email address on file at the time of payout.
If your PayPal address is invalid or rejects funds, the payment will be held until corrected.
3.4 No Commission on Personal Purchases
Purchases you make for yourself or household members do not generate commissions.
4. Tracking & Cookies
Sales are tracked using a unique referral link and cookies.
– Cookies typically last 30 days.
– If a customer deletes cookies or blocks tracking, we cannot guarantee commission.
– The last affiliate link clicked generally receives credit.
Tracking is provided “as-is,” and no compensation is owed for technical failures.
5. Approved Marketing Practices
Affiliates may promote the book using:
– Blog posts
– Videos
– Email newsletters
– Social media posts
– Banner ads
– Personal websites
– Direct outreach, as long as it is honest and non-deceptive
All marketing must be truthful, ethical, and legal, and must comply with:
– FTC guidelines on endorsements
– Anti-spam laws
– CAN-SPAM Act
– PayPal policies
– Any advertising laws relevant to your region
Affiliates must clearly disclose their affiliate relationship (e.g., “I may earn a commission if you purchase through my link.”).
6. Prohibited Activities
The following actions will immediately terminate your affiliate status and forfeit any unpaid commissions:
6.1 Illegal or deceptive conduct
Including but not limited to:
– False claims or misrepresentation of the book.
– Pretending to be the author, publisher, representative, or employee.
– Fake testimonials or fabricated reviews.
– Misleading statements about income potential.
6.2 Spam or unsolicited messaging
Including mass unsolicited emails, text messages, or direct-message spam.
6.3 Bidding on branded keywords
You may not run paid ads using:
– “Book Zero”
– “Danial Winberg”
– Any business trademarks
– Domain misspellings
6.4 Domain or social account impersonation
You may not create:
– Websites mimicking our branding
– Fake customer service accounts
– Social profiles pretending to be the Company
6.5 Coupon, discount, or rebate abuse
Unless explicitly authorized, affiliates may not:
– Offer unofficial discounts
– Promise cashback or rebates
– Redirect traffic through coupon websites
6.6 Cookie stuffing or forced redirects
Any attempt to generate commissions without genuine referrals is prohibited.
7. Content Requirements
Affiliates must ensure that:
– All promotional content is accurate and honest.
– Claims are supported by real information.
– No copyrighted material from the Company is replicated without permission (other than approved banners or provided materials).
– No hate speech, violence, pornography, or illegal content appears on promotional platforms.
We may request removal of any content we deem inappropriate.
8. Termination
Either party may terminate participation at any time, with or without cause.
The Company may terminate immediately if:
– You violate these Terms.
– Fraud or suspicious activity is detected.
– You bring reputational harm to the Company.
– Your actions violate laws or regulations.
Upon termination:
– Your affiliate link will be disabled.
– Any unpaid commissions earned legally and in compliance will be paid.
– Commissions obtained through prohibited conduct will be forfeited.
9. Changes to Terms
We reserve the right to modify or update these Terms at any time.
Changes will become effective upon posting. Continued participation after changes constitutes acceptance.
10. Intellectual Property
All logos, banners, designs, book covers, and text provided by the Company remain our exclusive property.
Affiliates may not:
– Alter branded graphics
– Claim ownership of materials
– Use images in a misleading manner
You receive a limited, revocable license to use materials solely for Program participation.
11. Limitation of Liability
The Company is not liable for:
– Loss of income
– Technical tracking failures
– Website downtime
– Affiliate’s own expenses
– Errors, omissions, or delays in payments beyond our control
– Any damages arising from participation in the Program
Your participation is entirely voluntary and at your own risk.
12. Indemnification
You agree to indemnify and hold harmless the Company, its owners, and partners from any claims, damages, or legal actions arising from:
– Your marketing practices
– Your violation of these Terms
– Misuse of affiliate materials
– Unlawful or unethical conduct
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any disputes shall be resolved through binding arbitration in California unless otherwise required by law.
14. Entire Agreement
These Terms constitute the entire agreement between you and the Company, superseding any prior communications or understandings.
15. Acceptance
By participating in the Affiliate Program, you acknowledge that:
– You have read and understand these Terms.
– You agree to abide by them fully.
– Your participation is voluntary and may be revoked at any time.
